Certification Required by the "Environmental Programs Assistance Act of 1984" The "Environmental Programs Assistance Act of 1984" requires certification (Fig. 2-1) [by the Federal, State, or local agency which is to receive the SEE enrollee(s)], that the cooperative agreement will not:
  1. displace any Federal, State, or local worker(s);
  2. prevent the rehiring of any laid-off Federal, State, or local worker(s); or
  3. affect existing service contracts.

This certification is prepared and signed by the designated official from the funding office or the SEE Coordinator. The Human Resources Officer (HRO) from the office that is requesting the SEE enrollee must also concur.

However, if the SEE enrollee is assigned to a State or local government, the EPA funding office or laboratory must receive written certification from the State or local Human Resources office that State or local government employees are not being displaced by SEE enrollees.

The certification (Fig. 2-1) must be in place prior to the award of the cooperative agreement.

A certification is required each time funding is obligated to the cooperative agreement.
